Regarding New Law Changes for Restricted Driving Privileges

As of January 1, 2025 – The following changes have been implemented from Senate Bill 500.

Automatic Restriction in lieu of Suspension for Unpaid Traffic Citations

If a person is otherwise eligible for restricted privileges under K.S.A. 8-2110, they will automatically go into a 60-day restriction in lieu of suspension.

  • If the traffic citations are not satisfied within the 60-day period, the license will then go into suspension. The person is eligible to apply for the restriction at that point at no cost. (application DC1020)

Restriction Time Frame

Currently, the restriction for failure to comply is for 12 months. As of January 1, 2025, the restriction for failure to comply will be indefinite if the driver applies and is approved (after the initial 60-day restriction).

Restricted Privileges for Revoked Drivers

A person who is revoked for habitual violator for no more than three driving while suspended convictions only, may be eligible for restricted privileges at no cost. (application DC1018)

  • The driving while suspended convictions must have occurred while only suspended on unpaid traffic citations. If approved, the restriction will be for up to 3 years or the remainder of their revocation period.

Non-Suspendable Traffic Violations

There are traffic violations that have been removed from being eligible for suspension.

  • The violations that are longer suspendable are “minor in possession” and “passenger under 14 riding in violation/unsafe conditions.

*Substantial Compliance for Failure to Comply

Currently, a failure to comply must be paid in full before the court notifies KDOR to reinstate the privileges. SB500 changed paid in full to “substantial compliance”.

  • KDOR cannot speak to what substantial compliance means because it is up to each court how they process those.
  • KDOR will fully reinstate a failure to comply suspension if a court notifies us of substantial compliance.

As of July 1, 2024 – The following restrictions have been added to the “Failure to Comply with a Traffic Citation” (DC1020) application.

  • To/From dropping off or picking up one or more children from childcare or school.
  • To/From purchasing groceries or fuel for their vehicle.
  • To/From any religious worship service held by a religious organization.

The Kansas Division of Vehicles may suspend a driver’s license for a variety of reasons including failure to provide proof of insurance, driving under the influence or unpaid fines.
