Gender Change

A temporary restraining order (TRO) has been issued by the Shawnee County District Court that prohibits Kansas Division of Vehicles (DOV) staff and its county treasurer partners from issuing new credentials (e.g. driver’s licenses, identification cards, etc.) that reclassify gender. As a result, the DOV will no longer process gender reclassification requests.

If a driver’s license or identification card applicant has a gender reclassification form that was approved before July 10, 2023, the applicant should be advised that DOV has been ordered to cease and desist from processing any application to change or display their gender in a manner that does not reflect their biological sex at birth as defined by Senate Bill 180 (2023).

What does this mean in practical terms?

Current DOV Credentials

The temporary court order does not invalidate any current customer’s unexpired driver’s license or identification card.

Replacement DOV Credentials

The temporary court order requires replaced or renewed customer credentials to reflect the customer’s sex at birth if that information is known to the DOV.

New DOV Credentials

The temporary court order requires new credentials to reflect the applicant’s sex at birth if that information is known to DOV.
